Conceptually the creation of a property interest and its transfer from one person to another have little in common. The first topic concerns the initial allocation of resources and is closely connected with various theories about the origin of property. The second topic involves the more mundane world of everyday legal transactions. Practically, however, the two topics are closely related. Very few tangible things today do not have an owner. Thus, creation of an original title frequently depends on the extinction of another title, either of another private owner or of the state.
